Pay-TV, broadcaster retransmission process gets FCC review

With broadcasters having more leverage in retransmission negotiations since new regulations were put in place in 1992, the FCC voted unanimously to review the rules that govern retransmission consent negotiations between pay-TV operators and broadcasters.

One of the key issues the regulator is going to review is the "totality of the circumstances test," which determines if the parties are negotiating in good faith. This review follows the passage by Congress of the Satellite Television Extension and Localism Act Reauthorization (STELAR) Act, a law that mandates that the FCC examine and modernize rules governing the video industry.
